Class terms & Conditions
1. PAYMENT
1.1 Invoices in respect of an Enrolled Student’s attendance for the enrolled timetabled classes shall be issued to you no later than [7] days prior to the start of each term. The outstanding balance is to then be paid no later than 1 day before the start of each term via BACS to a bank account nominated in writing by UDA or paid online through the Classforkids platform.
1.2 The payment terms set out in clause 1.1 shall apply to any Enrolled Student who is renewing their classes for the following term.
1.3 In the event that a student commences classes at UDA part-way through a term, then the attendance fee will be pro rata for the period of the term remaining.
1.4 If any amount in respect of the Enrolled Student’s attendance at UDA is due and outstanding to UDA or in the event of an Enrolled Student leaving UDA with fees due and outstanding, then, without limiting UDA’s remedies under clause 7 (Termination), UDA reserves the right to:
(a) suspend the Enrolled Student’s attendance at UDA until any and all overdue payments have been received in full; and
(b) pursue recovery of the debt by all legal means available to it.
1.5 Accounts with any amount outstanding from the previous term will not qualify for any promotional offers or discounts for the next term.
1.6 Once enrolled for the course booking, it is expected that the whole course be paid for. Whether paying in term payments or subscriptions, the amount will be required even if your child does not attend.
2. CANCELLATION OF CLASSES
2.1 Occasionally, it is necessary to temporarily change the venue of a class or postpone it to a later date, and we may even be forced to cancel a class. Where this occurs, UDA will give the Enrolled Student as much notice as is reasonably practicable by way of notifying the Parents either via email, phone or text. We will also use other methods to notify you of any such cancellations or changes to a class including making announcements on our studio noticeboard, UDA’s website and social media platforms.
2.2 We reserve the right to cancel any classes anytime up to and including the date of the class starts at our sole discretion. If UDA is required to cancel a class (“Cancelled Class”) it shall in good faith seek to reschedule the Cancelled Class. If an alternative date for the Cancelled Class cannot be found, or if the student cannot attend on the rescheduled date, a credit note will be issued for the amount of the Cancelled Class and applied to your account.
2.3 UDA reserves the right to move classes online if attendance at class is not possible due to, but not limited to, National or Local Lockdowns, severe weather or unexpected unavailability of venues.
2.4 If an Enrolled Student wants to cancel their attendance at any booked course, they must notify UDA in writing no later than two weeks prior to the start of the new term and we will recalculate your fees for the new term accordingly or end your subscription.
3. CREDIT
3.1 Credit will only be applied to your account to cover circumstances such as Cancelled Classes or long-term absence through injury or illness.
3.2 Fees will not be waived in respect of the Enrolled Student’s non-attendance due to family holidays, festival attendance, school trips, school exams or short-term injury or sickness, including isolation due to suspected or confirmed cases of Covid-19.
3.3 In the event of a temporary local or national lockdown due to government measures relating to Covid-19, UDA will credit the cancelled classes to your account. You can then use this credit once in-person classes resume. Credit will be rolled over to the following term if classes are unable to take place. No refunds will be made. Substitute online content will be made available for free with the option to donate.
3.4 Instances of long-term sickness or injury will be addressed on an individual basis and a medical note may need to be provided.
3.5 If a class is delayed or interrupted due to the fault of UDA, credit will be issued for that time if it is in excess of 50% of the total class time.
3.6 Credit can be applied to any amount due and payable to UDA in respect of an Enrolled Student’s attendance and can be applied to any renewal of attendance in future terms.
3.7 If an Enrolled Student leaves UDA and their account is in credit, UDA shall endeavour to repay such credit amount to the bank account nominated by the account holder in writing within [14] days from the receipt of the written notice.
4. DISCOUNTS
4.1 ‘Early bird discount’ can be applied to all timetabled group classes and will appear as a deduction on your invoice. For this discount, If you enroll for the full term with full term payment before the 1st day of the UDA term. A 2 class discount will be applied at the checkout when paying through class for kids.
5. EXAMINATIONS AND FESTIVALS
5.1 Invoices for Examinations and Festival Entries shall be sent as separate invoices at the time the Enrolled Student registers for any such examinations and/or festival entries.
5.2 All Examinations and Festival Entry invoices MUST be paid within 14 days of the date of such invoices.
6. PRIVATE TUITION
6.1 Fees for private 1:1 tuition must be paid by the day of the session.
6.2 Cancellation of any private tuition will result in the following percentage of the fee applied – 24 hours and less 100%, 25–48 hours plus 50%. Over 48 hours you will receive your money back.
7. TERMINATION OF CLASSES
7.1 Without affecting any other right or remedy available to it, UDA may terminate an Enrolled Student’s agreement to attend classes at UDA if:
(a) payment of fees due to UDA remain unpaid not less than [15] days after being notified in writing to make such payment; or
(b) UDA, in its sole discretion, determines that the Enrolled Student has broken our code of conduct, values, or been violent towards other students or staff.
7.2 On termination of this Agreement for any reason, clauses which expressly or by implication survive termination shall continue in full force and effect.
8. MISCELLANEOUS
8.1 Teachers are qualified, DBS checked, and insured and are fully aware of our child protection policy (which can be supplied on request).
8.2 Any changes to these Terms and Conditions will be announced via email and on our website.
9. UDA LIABILITIES
9.1 UDA does not accept responsibility for loss, damage or injury arising from errors or omissions on the registration form whether completed by you or the person in charge of the Enrolled Student at time of enrolment.
9.2 It is the students’ parent/guardians’ responsibility to check that registration information is correct and to email unityda.office@gmail.com immediately with any amendments or changes.
9.3 UDA does not accept responsibility for loss or damage to personal property.
9.4 UDA does not accept any responsibility for any loss or expense due to circumstances beyond our control including transport, fire, weather, and other such actions.
9.5 UDA is only responsible for Enrolled Students while they are attending their class. Enrolled Students cannot be supervised whilst they are outside class.
9.6 UDA holds Public Liability Insurance.
10. RESPONSIBILITIES OF PARENT OR GUARDIAN
10.1 These Terms and Conditions, and any enrolment forms you have signed and/or completed, constitute an agreement between you and us in connection to classes or any services superseding any prior agreement.
10.2 Attendance at class is deemed to be acceptance of the current Terms and Conditions.
10.3 It is the responsibility of the Parent or Guardian to notify UDA of any illness or injury that may affect the Enrolled Student’s participation at class.
10.4 It is the responsibility of the Parent or Guardian to ensure that we have the correct contact details for you and the Enrolled Student, including relevant medical information, telephone emergency contact number, email and address and that you keep us updated of any changes to these.
10.5 It is the responsibility of the Parent or Guardian to regularly read the website in order to be fully aware of all upcoming events.
10.6 In the event that we consider you to be in breach of these Terms & Conditions or that your child is disruptive to other pupils, staff, teachers or venue staff, we reserve the right to exclude your child from any activity within UDA.
10.7 Please retain all payment receipts. Where there is a dispute, if the Parent or Guardian cannot provide proof of payment, they must accept UDA’s records.
10.8 UDA hires premises from third parties; therefore, in addition to these Terms & Conditions, and UDA policies (in place from time to time), all Staff, Parents, Guardians and Enrolled Students must abide by the codes of conduct as set out by those third parties.
10.9 Parents or Guardians must make themselves aware of our Privacy and Child Protection policies.
10.10 UDA is only responsible for Enrolled Students while they are in class. It is the responsibility of the Parent or Guardian to supervise their own children in the car parks at all our venues. UDA will endeavour to have DBS checked assistants in all our classes to help supervise any Enrolled Students who need the toilet, however these assistants are not allowed to enter the toilet with a child, nor is UDA responsible for the supervision of any Enrolled Student outside of class, including going to the toilet. Wherever possible, Enrolled Students should go to the toilet before attending class.
10.11 The parents or Guardians are responsible for ensuring all medical equipment required is on site, and must make a member of UDA staff aware.
